    The several PROPERTIES belonging to the late Mr Peter Armstrong, situate in the parish of Yarrowee.
    Lot I. That splendid orchard called “Alston Gardens,” about 4 acres, being part freehold and part under residence area; deeply trenched, grand soil, and trees in full bearing; with 7-room cottage thereon, kitchen, and jam-making premises, with all necessary appliances; stable, shed, pigsty, &c. This property is well protected from the north winds, and is only about 4½ miles from Ballarat.
    Lot II. 1½ acres, residence area, with small cottage thereon, adjoining Mr Jenkin's property, and next but one to the above.
    Lot III. About 1 acre, held under garden license, immediately opposite Lot I.
    Lot IV. About 11 acres, on the Napoleons road, being partly freehold and part held under 49th section, and nearly opposite Lot I.
    Lot V. About 20 acres, held under 49th section; all rents paid, and numbered allotment 16 of section IV on parish plan of Yarrowee.

    Being an executors' sale, the properties must be sold, and will be offered in lots as above.
    The FURNITURE comprises chiffonier, sofa, tables, pier-glass, chairs, chest of drawers, looking glass, bedstead, &c.
    The Live Stock consist of horse, 3 milch cows, steer, heifer, and bull calf. There are also spring-cart, dray, quantity tools, and other sundries.

    THE RED JACKET MUTINY CASE.

    On the 17th instant, Captain Samuel Reed, of the clipper ship Red Jacket, which arrived here from Liverpool on the 16th, preferred a charge of riotous and insubordinate conduct (amounting to assault and mutiny) against five of his cabin passengers, named John Barnett, Francisco Romero, John Hickey, William Hickey, and Alfred Kinahan be fore the Water Police Court, Williamstown. The defendants pleaded not guilty; and, after an investigation which occupied two days, the decision of the Court was : That John Barnett and John Hickey be fined £2 and costs: and that the other defendants be discharged. The Magistrates on the Bench were Crawford A D. Pasco, Esq. R.N. and P.M, and Francis Orme, Esq. J P. From a careful examination of the testimony on both sides, we submit the following statement as a correct and impartial summary of the case. The ship left Liverpool on the 4th of May, and everything seemed to have gone on quietly enough till about the 25th of that month. On that day, in consequence of being ordered out of the after saloon by the ladies, a requisition. signed by ten of the male cabin passengers, was presented to the captain, selling forth that great inconvenience and annoyance had arisen from want of some definite rules for their guidance, and requesting him to supply this desideratum by drawing up a distinct code of regulations regard ing the hours of meals, the hours during which the after-saloon was to vacated for the exclusive use of the ladies, the putting out of the lights at night, etc, stipulating, at the same time, that the regulations should, in the first place, he submitted for their approval, and, if adopted, then to be posted up in a conspicuous part of the cabin, and adhered to strictly by all parties.
    After the receipt of this requisition, Captain Reed drew up a series of regulations, but decidedly objected In submitting them for the approval of the requisitionists. They were as follows: - l. Breakfast at nine o’clock, dinner at two o clock, tea at six o'clock,, as hitherto. 2. All gentlemen to rise on the ringing of the first bell (half past seven o clock) and be dressed by breakfast time. 3. All gentlemen are expected, in courtesy to the ladies, to come to table in a becoming dress, and not, as hitherto, without coats. 4. Gentlemen will attend to the dinner bell, and, in deference to the ladies, it is hoped that more punctuality than hitherto will be observed. 5. All lights in the saloon and state rooms to be out at 11. The after saloon is exclusively set apart for the ladies; unless gentle men are especially invited there, their presence will in future be considered an insult to them. 7. In con sequence of card playing having led to gambling, insobriety, and conduct too disgraceful to repeat, the commander forbids its continuance, and he cautions those who would set aside his power and authority. These two last regulations gave instant offence to the male passengers generally; and as the captain was proceeding to retire in the after saloon, Mr Barnet (one of the defendants) requested him to stay and hear what the passengers had to say. This the captain declined doing, hoping that the passengers would attend to his regulations, and he then retired, Burnett then said he would be—if he would recognise these regulations,, and if all the passengers were of his opinion, they would not submit to them; and now that war was declared, it would be war to the knife. Mr. John Hickey said that he had a sword in his cabin, and as long as he could wield it he would defend his rights, and would never submit to such insulting regulations. Barnett and John Hickey then proceeded to enter the after saloon, followed by Francisco Romero, William Hickey, Alfred Kinahan, Clements Hanbury, John Sk-ing, and John Reld. A scuffle ensued, in consequence of the captain calling in some of his officers, and employing force to eject the passengers. Of course this scene alarmed the ladies, who fled to their state rooms. The result of this resistance was that the captain ordered Barnett, Romero and Hickeys, Hanbury, and Reed, to be confined to their respective cabins, placing a guard over them for the night, and telling his men to cut them down if they attempted to escape. On the night of the 27th, in consequence of some menacing language which had been used he ordered the two Hickeys and Romero to be put in irons, from which they were next day released on their parole of honour to observe the captain's orders. The captain, however, gave the defendants notice, that they were to consider them selves under arrest during the remainder of the voyage, and forbid them holding any communication whatever with any of the passengers on any occasion. And so matters stood between the belligerent parties till the ship readied Hobson's Bay.
    The captain alleged that some of the gentlemen (Barnett and Romero) had been drunk, and using improper language, rendering them unfit for the company of ladies. But Doctor Robinson, the surgeon of the ship, distinctly testifies that he never heard the defendants use any obscene or improper language in the presence of the ladies. He states that he saw Burnett drunk and Romero in a high state of excitement from liquor. Mr Yaxoll, a married cabin passenger, who remained neutral; or rather (as he admits) from policy sided with the captain, testifies that he considers the Messrs. Hickey and Kinahan are most harmless young men! and that Mr. Barnett and Mr, Romero when excited on the deck, have used language which was not suitable for a drawing room. He considers the conduct of Captain Reed was quite the reverse to that of being kind to his passengers. His wife and child had received most brutal conduct from the captain. He only once saw Mr, Barnett intoxicated, and has seen Mr. Romero under the influence of liquor. He has heard Mr. Barnett, on the occasion of his being intoxicated, use improper language on the deck, but not in presence of any lady. And in explanation of his apparent acquiescence with the captain, he states that, although no threat was used to him, he acquiesced, thinking that he might meet with the same fate as the other passengers if he did not do so. The question in this case seems to be, as to the right of the male passengers to enter the after saloon! and that was fully admitted by Captain Reed himself on his cross examination. He says, 'It was distinctly understood by the passengers, that the cabin was to be open to all, as long as they conducted themselves properly,' The berths of several of the male unmarried passengers were off the after saloon, and could not be entered except through the saloon. Several passengers called as witnesses, state that, when they took their passages, the agent told them distinctly that they were to have the free use of the cabin termed the Iadies' saloon. Mr. Skilling, a witness, states, that there was an agreement among themselves, for the convenience of the ladies, that they (the gentlemen] should vacate the after cabin for a certain time during the day, and that they adhered to that agreement. Doctor Robinson says, that he considers Messrs. Hickey and Kinahan as sober men: and he does not believe that any of the defendants were habitual drunkards. He says that Capt. Reed, about 3 weeks after they sailed, got into an irritable and nervous state of mind, and this was previous to the disturbance. After put ting Romero and the two Hickeys in irons, the capt. explained to the doctor his reason for doing so. His reason for putting William Hickey in irons was because his brother was in irons, and occupied the same cabin ; and he thought the safely of the ship and the passengers required it. At the same time the doctor said to the captain that he believed a hair of his head would not he touched by any of the gentlemen ; but if he thought the safety of the ship required it, he had better exercise his authority as he thought best. He states, also, that had the power rested with him, he would not have placed the gentlemen in irons; on the contrary, he should have prevented the captain’s doing so. The doctor declared that he had never read the Passengers Act.
    To prevent if possible, such errors occurring again, and for the instruction of all captains and surgeons of passenger-ships we shall conclude this report by extracting the 56th section of the Act, 15 and 16, Viet., cap. 44;—"In every passenger-ship, the medical practitioner on board aided by the master thereof, or in the absence of such medical practitioner, the master of the ship, is hereby empowered to exact obedience to all such rules and regulations (as may be prescribed by any order of Her Majesty's Privy Council); and any person who shall neglect or refuse to obey any such rules or regulations, or who shall obstruct the medical practitioner or master of the ship in the execution of any duty imposed upon him by any such rules or regulations, or who shall be guilty of riotous or insubordinate con duct shall be liable, for each offence, to a penalty not exceeding two pounds sterling, and in addition thereto, to be confined in the common gaol for any period, not exceeding one month, at the direction of the justices who shall adjudicate on the complaint.’ This was the law on which the Court fined John Barnett and John Hickey £2 each. Such then is the sum and sub stance of the great case of the Red Jacket mutiny, which turns out (as far as the accusation against the passengers is concerned) to be a mere bottle of smoke. We understand that the defendants in the case intend to commence actions for damages against Captain Reed in the Supreme Court. It was under stood by the Court at Williamstown, that the com plaint ol the third mate of the Red Jacket against the captain, for keeping him in irons forty days, was to have been heard yesterday ; but when the complainant’s lawyer appeared, he found that a compromise had been effected, and that the case would not come into court. - 'Argus.'

    Elizabeth died intestate but owned land of 20 acres in the Parish of Yarrowee, County of Grant (Allotment 14, Section 6) which was rented out for grazing. 'Land is fenced but otherwise unimproved and there are no buildings or improvements thereon and the same is used for grazing purposes. Land is of very poor quality and is valued at cost of 1 pound 10 shillings per acre. Land is rented at 2 pound a year. Total value 30 pounds.' There was no personal estate.

    Peter's attests to himself, and John, Joseph and Thomas George Armstrong, Elizabeth's brothers, all farmers at Cambrian Hill, and her sister Hannah Jane Hetherington, also of Cambrian Hill, as her only next of kin surviving. Peter also states that he is the only person entitled to the administration of Elizabeth’s estate.
    Hannah's husband, John Hetherington, butcher, of Broomfield, stated that he had freehold property at Broomfield consisting of three quarters of an acre to the value of fifty pounds.

    Peter died on 4 January 1890, presumably before he carried out the administration of his daughter’s estate because on 21 January 1890, brother John, along with brothers Joseph, Thomas George and married sister Jane Hetherington, all of Cambrian Hill, state that they are the only persons lawfully entitled to share in the distribution of the estate. John also seeks to be appointed as the administrator.

    An inquest into Joseph’s death was held on 10 June 1912 at White Hills.

    "Having inquired upon the part of our Lord the King, when, where, how, and by what means the said Joseph Wilkinson Armstrong came by his death, I do say that the said Joseph Wilkinson Armstrong died at Welsford Rifle Range near Bendigo on 9th June 1912 from atheroma of the valves of the heart.
    Report of John Greenshields, Constable, White Hills:
    It was reported to me at 1.15am this morning 10.6.12 that Joseph Wilkinson Armstrong aged 59 years [sic] was found dead on his tricycle near the Wellsford Rifle Range Siding. Deceased was a Ganger in the charge of the Railway Line repairs on the Heathcote Line.
    At 8.30am this morning I visited the depot and made an examination of the body and could not find any marks of violence or any suspicious circumstances and instructed the removal of the body to his late residence No. 33 McCrae St, White Hills.
    Joseph Stephenson Armstrong, son of the deceased, states that his father the deceased left his home at 5.15pm on 9.6.12 to go along the Railway Line towards the Rifle Range Siding at Wellsford. He was in his usual good health when leaving home. He did not return and at 10pm in company with John Mills we went out along the line and found my father lying back dead on his tricycle about 2 chains on the Bendigo side of the Wellsford Rifle Range Siding. There were no signs of a struggle or any marks of violence. We removed the body to a shed at the Rifle Range.
    John Mills stated: I am a Railway Repairer and the deceased was the Ganger. I reported to him that I was told that a piece of firewood was lying on the Railway Line near the Rifle Range. He said he would go out and see about it. He was then in his usual health. At 10pm in company with Joseph Stephenson Armstrong I went along the Railway Line to near the Siding at Rifle Butts and found the deceased lying dead on his tricycle. I assisted to remove the body to a shed at the Rifle range and reported the matter to the police.
    There is a detailed report from Dr Oliver Penfold on the condition of Jospeh’s heart. it is very hard to read the doctor’s writing!
    This deponent Joseph Stephenson Armstrong, on his oath saith, I am a coach painter residing at White Hills. The deceased Joseph Wilkinson Armstrong who was 58 years old was my father and I lived with him at White Hills.
    He went up to the hospital yesterday to visit my cousin his nephew and came back home at 4.45pm. I saw him last alive at 5.15pm - he was then going to remove an obstruction on the railway line near the rifle butts & he changed his clothes.
    As he was not at home (not having come back since he left at 5.15pm) at 10pm I went to the home of the witness Mills and he took me on his trolly along the railway line to Heathcote. When we got about 2 chains from the platform at the rifle butts we saw the tricycle on the line and on going up to it found my father lying backwards on the tricycle quite dead. His body was placed in the rifle butts shed and the death was reported to the police.
    He has always been well & never complained of anything save indigestion. He appeared in good health & spirits yesterday.

    Peter died on 4 January 1890, presumably before he carried out the administration of his daughter’s estate because on 21 January 1890, brother John, along with brothers Joseph, Thomas George and married sister Jane Hetherington, all of Cambrian Hill, state that they are the only persons lawfully entitled to share in the distribution of the estate. John also seeks to be appointed as the administrator.

    ARREST OF A STATE SCHOOL TEACHER.
    ALLEGED TAMPERING WITH FEMALE PUPILS.
    SALE, Thursday.
    As stated in The Age of yesterday, Thomas G. Armstrong was dismissed by the Education department, consequent upon an inquiry held by the Public Service Board into charges of Indecently assaulting female pupils at the Clydebank State school, of which he was head teacher. Following upon this, on
    Wednesday night Constable Chandler arrested Armstrong, who denied the charges. Hs was brought before the Sale police court this morn ing — Mr. Johnstone, J.P., presiding — and was formally charged with having assaulted a girl under tho age of 16 years in or about the month of July. The constable deposed that he had been present at the official inquiry, when he heard the evidence given by several girls. Accused was remanded to the 23rd inst., and on his applying for bail Sergeant M'Gann asked that it should be made substantial, as there would be other similar charges laid. Bail was fixed in two sureties of £100 each and accused in £200. He was then removed to gaol.

    SALE POLICE COURT. FRIDAY, AUGUST 23RD. (Before Mr Creswell, P.M.) ALLEGED TAMPERING WITH STATE SCHOOL GIRLS. Thomas G. Armstrong, formerly head teacher at the Clydebank State School, was brought up on remand charged with in decently assaulting May Jenkins and Ada Williams, both under the age of 16 years, some time in July. Sergeant M'Gann conducted the prosecution and Mr Bushe appeared for the accused. The charges were taken separately. The court was cleared. The evidence went to show that accused committed at various times during school hours, or in the schoolroom during the luncheon hour, indecent assaults on the witnesses. According to the witnesses accused had crossly misconducted himself two or three times a week for a long time past, on some occasions in view of many of the scholars. Asked why they had not informed their parents when the first assault took place, or subsequently, the witnesses replied that they were afraid of being beaten by their mothers. The statement of the principal witnesses was that they resolved to tell their mothers shortly before the inquiry ordered by the Education department, be cause one girl said she would, and "take the threshing." Then six of them talked it over during the school dinner hour, and resolved to tell also. At the conclusion of the first charge Mr Bushe submitted there was not sufficient evidence for a commitment. He held there was a considerable divergence in the statements of the witnesses, and that it was im probable the offence should have been committed in a crowded schoolroom. Still if Mr Creswell intimated that it was a case for a jury he would not say anything further. Mr Creswell, P.M., said it was not for him to say what amount of credibility was to be attached to the witnesses. Corroboration was not necessary under the section of the Act. The second charge was then gone into, and accused was committed for trial on both charges to the Sale Supreme Court to be held on December 3rd. Bail was allowed in two sureties of £50 each and second of £100 personal, on each charge. Mr Anderson Dobson, grazier, and Mr Robert Dobson, farmer, both of Alexandra, gave the bail. Two other charges against accused were adjourned till next Friday, Mr Creswell having to leave for Pakenham by the afternoon train.

The evidence of the assault against Ruby Little, aged 11 years, was as in the other cases difficult to follow on account of the children being unable to fix dates. Accord ing to the witnesses the assaults were very frequent and extended over a period of some years. One of the witnesses "couldn't re member," so frequently, that Sergeant M'Gann, put the question whether her father had not gone bail for accused. Mr Bushe objected to the question, and to her examination on her original statement unless she was treated as a hostile witness. Consequently her examination closed abruptly. Emily Nugent, domestic servant to Mr J. T. Little, said that in July 16th, Ruby complained to her of accused's conduct. Mr Bushe objected to the evidence on the ground that Ruby told witness four days after the alleged assault. Mr Creswell, P. M., decided to receive the evidence, noting that Mr Bushe objected to its admission. Witness said that on the afternoon of July 16th, Ruby went to her in the kitchen as soon as she came home from her music lesson and said "I'll tell you something I'm afraid to tell mother." After hearing the account of the assault witness told Ruby to tell her mother, which she did the same day. J. T. Little said that from what he was told on July 16th, he went the same evening to see the accused. Witness told accused what he had been informed about his con duct. Accused replied "I did not." Wit ness told him that he would go into Sale next morning and have him arrested any way. Previous to that evening was on friendly terms with accused. Could not see how accused received the information. It was very dark, and witness met him outside the house. Witness thought he was more excited than accused. Mr Creswell committed accused for trial at the Sale Supreme Court on December 3rd. Bail was accepted, self £50, and two sureties of £25 each, furnished by J. S. H. Hammond and Robert Dobson. The other charge was of assaulting Annie Miller, aged 12 years, some time during the month of June or July last. Mr Creswell committed accused for trial, accepting the same bail.

    SALE, Friday. - In August last Thomas George Armstrong, head teacher of the state school at Clydebank was arrested on several charges of tampering with girl pupils He was dismissed the service, and later was committed for trial on several charges at the Sale Supreme Court on December 3. He was allowed out on substantial bail, and ever since has been residing in the house he occupied as head teacher, which is in the school grounds. Several residents objected to send their children to the school while Armstrong was about, and several parents, including one J. Jenkins, whose daughter is a witness against Arm strong, were summoned for non-compliance with the Education Act. The police magistrate (Mr Creswell) did not consider the objection sufficient, and fined them 2s 6d. in each case.

    JUDGE HODGES ON TRIAL BY JURY.
    SALE, Tuesday.
    Thomas George Armstrong, late head teacher of Clyde Bank State school, was charged on four separate counts with indecently assaulting four female pupils under the age of 16 years. He was defended by Mr. Forlonge. On one count, the evidence not being satisfactory, the jury, by direction of his Honor, returned a verdict of not guilty, and after a retirement of an hour and a half they returned a verdict of guilty on two of the other counts, and not guilty on the third. The jury recommended him to mercy on account of the suffering he had endured, and on account of his wife and family. Accused's defence was practically that he had flogged a boy at the school last December, that at an inquiry before the inspector he had been exonerated, and that since then he had been subjected to persecution to which this was the sequel. He was remanded for sentence.
