My dear wife ELIZABETH all my Freehold and Leasehold Tenements Messuages and premises. And also the careful use of all my household furniture,goods, plate, linen, books and trinkets, and also all the Interest and Dividends to accrue upon all my money bills, bonds, or other securities, andall other any real and personal estate. To hold the same severally unto my said wife for and during her life, and from and immediately after herdecease, I give and bequeath the following:
To my son ROBERT WILLIAMS all that dwelling house which I now occupy and also the dwelling house lately occupied by Andrew Bawden and the gardens infront and behind the same respectively and their appertunances situate at Plain-an-Gwarry. I also give and bequeath to my said son Robert all thatfield or close of land with the appertunances situate in the Parish of St Hilary called the Three Cornered Field containing about one acre of land.Also all that small thatched house formerly occupied by Ann King, and also all that field containing about two acres now in the occupation of MessrsNagor and Davey or their undertenants also situate in the said Parish of St Hilary. To hold the aforesaid dwelling houses and gardens two fields andthatched house with their appurtenances from and immediately after the death of my said wife unto him my said son ROBERT WILLIAMS for and during hislife. And I do hereby will and direct that the garden belonging to the house now in my occupation shall extend as far north as the road by the riverand that a hedge shall be built by my said son ROBERT his executors or administrators as soon as conveniently may be after my decease from the oldhedge straight in a northerly direction to divide the said last mentioned garden so as the northern part thereof shall be of the same breadth as thesouthern part thereof and I will it shall be included in the beforementioned devise or bequest to my said son ROBERT during his life. Also all thatfield or close of land called Nicholl's field being about three quarters of an acre situate in the Parish of Redruth near Cock's Well and now in myoccupation. To hold the same to my said son ROBERT during his life, and from and immediately after the decease of my said son ROBERT, I give deviseand bequeath all every and singular the aforesaid several messuages dwelling-houses, gardens, fields and premises hereinbefore devised andbequeathed to my said son ROBERT, unto my friend WILLIAM TYACK of the Parish of Saint Hilary, blacksmith. Upon trust nevertheless that he do andshall pay the rents and profits to arise therefrom severally and respectively equally unto and amongst all and every child and children of my saidson ROBERT in equal shares as tenants in common. I also give and bequeath unto my said son ROBERT WILLIAMS my corner glass cupboard, the safe andfire-grates and the oven in the kitchen now in the house I live in, and also all the fire-grates in the dwelling-house lately in the occupation ofAndrew Bawden, to hold to my said son ROBERT immediately after the death of my said wife.
I give and bequeath to my grandson SAMUEL WILLIAMS the portrait of my son SAMUEL WILLIAMS deceased, to be delivered to him after or upon the deathof my said wife.
I give and bequeath unto the before named WILLIAM TYACK all that messuage inn and premises called the Miners Inn with the ground in front and gardenbehind the same with the appertunances situate at Plain-an-Gwarry aforesaid. To hold the same unto the said William Tyack from and immediately onthe death of my said wife for and during all my term estate and interest therein. Upon trust nevertheless that the said William Tyack do and shallfrom time to time and at all times during such my term estate and interest therein pay the rents issues and profits thereof unto my daughter GRACEthe wife of WILLIAM GOODMAN to be paid to her sole and separate use independently and without any intermediary or control thereof and not subject orliable to the debts contracts or engagements of her present or any future husband.
I also give and bequeath unto the before named WILLIAM TYACK all that eastern house being the thatched house with the garden and appurtenances infront and behind the same situate at Plain-an-Gwarry aforesaid, and also all those seven fields or closes of land with the appertunances situatenear Wheal Gilbert mine in the Parish of Redruth containing about three acres and half. To hold the same severally unto the said WILLIAM TYACK fromand immediately on the death of my said wife for and during all my term estate and interest therein severally. Upon trust nevertheless that thesaid WILLIAM TYACK do and shall from time to time and at times during my terms estate or interests to therein pay over the rents, issues and profitsthereof severally unto my daughter CATHERINE the wife of BENJAMIN WILLIAMS of the Parish of St Agnes, to be paid to her sole and separate useindependently and without any intermediary or control thereof and not subject or liable to the debts contracts or engagements of her present or anyfuture husband.
I also give and bequeath unto the before named WILLIAM TYACK all that field or close of land called the Middlefield containing about one acre ofland situate in the village of Relubbus in the said Parish of St Hilary. To hold the same unto the said WILLIAM TYACK from and immediately on thedeath of my said wife for and during all my then term estate and interest therein. Upon trust nevertheless to pay and divide the rents thereof toand equally amongst my three grand-children LOUISA, RICHARD and LAVINIA BETSEY, the children of my late dear daughter BETSEY VEALE, deceased, and tothe survivors, and survivor, of them, and I also give and bequeath unto the said WILLIAM TYACK on the death of my said wife the sum of one hundredand fifty pounds. Upon trust to invest the same in Government or some other good security or securities at interest and from time to time to pay andapply the interest or dividends thereof in and towards the maintenance and education of my said three grand-children LOUISA, RICHARD and LAVINIABETSEY until they shall severally and respectively attain the age of twenty one years, and in case any one or more of them shall die beforeattaining unto such age then in trust as aforesaid for the maintenance and education of the survivors, and on my said three grand-children attainingthe age of twenty one years, then upon this further trust to pay over the said sum of one hundred and fifty pounds to and equal amongst them or thesurvivors of them, or the whole thereof to such survivor of them. But in case all of them my said grand-children LOUISA, RICHARD and LAVINIA BETSEY,shall depart this life before attaining and completing the age of twenty one years, then upon further trust to pay over the said sum of one hundredand fifty pounds to my said son ROBERT and my said three daughters GRACE, CATHERINE and MARY the wife of the said WILLIAM TYACK in equal shares andproportions or to such survivors or to the survivor of them who shall be living at the time of the death of all my said grand-children LOUISA,RICHARD and LAVINIA BETSEY, before mentioned.
I also give and bequeath all every and singular my household furniture, plate, linen, books and implements, whatsoever (except the corner glasscupboard, safe and fire-grates and oven and the portrait of my son SAMUEL WILLIAMS deceased, before bequeathed) together with all the rest andresidue of my real and personal estate whatsoever to my four children, the before named ROBERT WILLIAMS, GRACE GOODMAN, CATHERINE WILLIAMS and MARYTYACK share and share alike as tenants in common, and I give all my wearing apparel and cloathes [sic] to my said son ROBERT.
I give and bequeath unto my grand-son WILLIAM TYACK the younger my silver watch, provided he shall return to England, but if he should die abroad orbe reasonably supposed to die abroad then my will is and I do hereby give and bequeath the same silver watch with its appendages to my grand-sonJOHN TYACK, the division and delivery of all the before mentioned bequests to take place and be made immediately after my said wife's decease.
And I do hereby direct and order that my said son ROBERT shall pay towards the conventionary rent for the premises hereinbefore bequeathed to himsituate at Plain-an-Gwarry aforesaid the yearly sum of three pounds a year during his interest therein and for the premises hereinbefore bequeathedto him situate in Saint Hilary the yearly sum of ten shillings and six pences towards the conventionary rent thereof during his interest therein,and that of my three grand-children the before named LOUISA, RICHARD and LAVINIA BETSEY VEALE, shall pay in respect of the premises I havebequeathed to them in Saint Hilary five shillings and six pence per year during their interest therein.
And my daughter GRACE GOODMAN shall pay for her premises at Plain-an-Gwarry aforesaid the yearly sum of eleven shillings and six pence during herinterest therein.
And my daughter CATHERINE WILLIAMS shall pay for her premises at Plain-an-Gwarry and Wheal Gilbert the yearly sum of one pound nine shillings andsixpence during her interest therein.
I also give and bequeath unto my sister SARAH GOLDSWORTHY the sum of eighteen pence weekly during her life. And I do hereby nominate constitute andappoint the before named WILLIAM TYACK executor of this my last will and testament. In witness whereof I the said Robert Williams the elder have tothis my last will and testament contained on three sheets of paper to the first pages hereof have set my hand and to this last sheet hereof, set myhand and seal.
